Article III — Unit Ownership and Common Elements

This article addresses how ownership interests are structured. Each unit owner holds title to their individual Unit and, in conjunction with that ownership, an undivided percentage interest in the Common Elements. That percentage is typically used to allocate voting rights and shares of common expenses.
It also covers restrictions on partition — unit owners generally cannot force a division or sale of the Common Elements — and clarifies that Common Elements must remain undivided and available for use by all owners according to their designated purpose, except for Limited Common Elements reserved for specific units.
